3. SMS/Text Message Communications

Consumer SMS Communications

With your express written consent, we may send SMS/text messages to you regarding service appointments, scheduling confirmations, technician arrival notifications, and other service-related updates. By opting in to receive text messages from SmartHomes, you agree to the following:

  • Message Frequency: You may receive up to 10 messages per day, depending on service activity.
  • Message & Data Rates: Message and data rates may apply. Contact your wireless carrier for details about your messaging plan.
  • Opt-Out: You may opt out of SMS communications at any time by replying STOP to any message. You will receive a one-time confirmation message and no further texts will be sent.
  • Help: Reply HELP to any message for assistance, or contact us at support@smarthomes.us.
  • Carriers Supported: Compatible with all major U.S. wireless carriers.

TCPA Compliance

SmartHomes complies with the Telephone Consumer Protection Act (TCPA) and all applicable federal and state regulations regarding text messaging and telemarketing. We will not send SMS messages to any individual who has not provided prior express written consent. Consent is not a condition of purchasing any goods or services. We maintain records of all opt-in consents including the date, time, method of consent, and phone number enrolled.

SMS Data Usage

Phone numbers and SMS consent data collected for text messaging purposes are used solely for delivering the messages described above. We do not sell, rent, or share your phone number or SMS consent information with third parties for their marketing purposes. SMS opt-in data and consent records will not be shared with any third parties except as required to deliver messages (e.g., our SMS service provider) or as required by law.

Internal/Employee SMS Communications

We also use SMS messaging for internal operational communications with employees and contractors, including dispatch notifications, schedule updates, and job assignments. Employee and contractor SMS consent is obtained during onboarding.

4. Information Sharing and Disclosure

We do not sell your personal information. We may share your information in the following circumstances:

  • Service Providers: We share information with trusted third-party service providers who assist us in operating our business, such as payment processors, scheduling software (Jobber), remote monitoring platforms (OvrC/SnapOne), analytics providers, and SMS delivery services. These providers are contractually obligated to protect your information and use it only for the services they provide to us.
  • Legal Requirements: We may disclose your information when required by law, subpoena, court order, or government regulation, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

SMS consent records are retained for the duration of the messaging relationship plus five (5) years, in compliance with TCPA and CTIA guidelines.
